These Terms of Service govern the use of the Onickz Artworks online store and the purchase of products available through photo.onickz.com.
The store is operated by Onickz Artworks, based in Paris, France. The website and ecommerce services are powered by Shopify.
By accessing this website or placing an order, you agree to these Terms of Service, together with our Privacy Policy, Shipping Policy and Refund Policy.
1. Products
Onickz Artworks offers fine art photography prints, including limited editions, signed and numbered editions and other photographic works.
We make every reasonable effort to display photographs, colours, tones and materials accurately. However, colours and appearance may vary depending on the screen, device, paper, printing process and viewing conditions.
Dimensions, paper type, edition size and other specifications are stated on each product page.
Limited editions are produced only up to the number of copies indicated for the relevant edition.
2. Orders
Placing an order constitutes an offer to purchase the selected products.
An order becomes confirmed once payment has been successfully processed and an order confirmation has been issued.
We reserve the right to refuse or cancel an order in the event of an obvious pricing error, payment problem, suspected fraud, product unavailability or other legitimate reason. If payment has already been collected, the corresponding amount will be refunded.
3. Prices and payment
Prices are displayed in the currency indicated on the website.
The final amount payable, including applicable taxes and shipping charges, is displayed before the order is confirmed.
Customers are responsible for any customs duties, import taxes or other charges that may apply in their country, unless otherwise stated during checkout.
Available payment methods are displayed at checkout.
4. Production and limited editions
Certain prints are produced individually after an order is placed.
Fine art editions may be hand-signed and individually numbered by the artist, as specified on the relevant product page.
The numbering of a limited edition refers to the total number of prints produced in that specific edition and format.
Once the stated edition is sold out, no additional numbered prints will be produced as part of that edition.
5. Shipping and delivery
Orders are shipped to the destinations available during checkout.
Estimated preparation and delivery times are provided for guidance and may vary depending on destination, carrier operations, customs procedures or circumstances outside our reasonable control.
Customers must provide a complete and accurate delivery address.

6. Returns and right of withdrawal
Consumers located in the European Union generally have a statutory right to withdraw from a distance purchase within 14 days after receiving the goods, subject to the exceptions provided by applicable law.
The fact that a standard photographic print is printed after an order is received does not, by itself, necessarily remove this right. The statutory exception principally concerns products manufactured according to the customer's specifications or clearly personalised.
Products that have been specifically customised or personalised at the customer's request may therefore be excluded from the right of withdrawal where permitted by law.
Items must be returned in their original condition and appropriately protected for transport.
Products received damaged, defective or incorrect should be reported promptly so that we can provide an appropriate solution.

7. Intellectual property
All photographs, artworks, images, texts, graphics, branding and other original content displayed on this website are protected by copyright and other intellectual property rights.
Purchasing a physical print transfers ownership of that physical copy only.
It does not transfer copyright, reproduction rights or commercial exploitation rights relating to the underlying photograph or artwork.
No photograph or other content from this website may be reproduced, copied, distributed, modified, resold, published or used commercially without prior written permission from the rights holder.
8. Personal information
Personal information provided through the website is processed in accordance with our Privacy Policy.
Because the store is powered by Shopify, certain information may also be processed by Shopify and its service providers for the operation of the ecommerce platform. This principle is also contained in the Shopify template you received.
9. Shopify
This store is powered by Shopify.
However, purchases made through this store are transactions directly between the customer and Onickz Artworks. Shopify provides the ecommerce technology but is not the seller of the products offered by Onickz Artworks.
10. Liability
Nothing in these Terms excludes or limits any consumer rights or statutory guarantees that cannot legally be excluded under applicable law.
To the maximum extent permitted by applicable law, Onickz Artworks shall not be liable for indirect or consequential losses resulting from circumstances outside its reasonable control.
11. Changes to these Terms
We may update these Terms from time to time, particularly to reflect changes to our services, products or applicable legislation.
The version published on this website at the time an order is placed will apply to that order.
12. Applicable law
These Terms are governed by French law, without depriving consumers residing in another country of any mandatory protections granted by the laws applicable to them.
For consumers within the European Union, mandatory consumer protection legislation remains applicable.
